Terms & Conditions

Ordering from www.the13thfloor.co.uk
1.1 You must be at least 18 years of age to place an order.
1.2 By entering your credit card details at Worldpay you are offering to buy the products at the stated price and agreeing to our terms and conditions.
1.3 You will only own the goods once we have received payment in full. We can accept payment by Paypal and personal cheque in addition to our usual credit / debit card service, although items will not be dispatched until payment has cleared. Please contact us at support@the13thfloor.co.uk if you would like to place an order using personal cheque.
1.4 Prices are in pounds sterling and include UK VAT as appropriate. Overseas customers are responsible for any customs fees or import tax due. A minimum order total of £3.50 applies to all orders.

Pre-Orders
1.5 To place a pre-order you can checkout with out of stock pre-order items to reserve them. If you checkout your credit or debit card will be charged immediately and we will despatch the item to you as soon as it is in stock.
1.6 Pre-orders are allocated on a "first come, first serve" basis.
1.7 If the price of a pre-order item is reduced before release, you will be refunded the difference between the price you paid and the lower price.

Supply
2.1 Products are subject to availability. We will refund any money already paid if we cannot supply the product. Please note that out of stock items occasionally go out of print and can no longer be back ordered from the manufacturer.
2.2 We reserve the right to refuse to supply any products ordered.

Delivery
3.1 UK Orders : In stock orders received before 2pm Greenwich Mean Time, Monday to Friday, (excluding Bank Holidays and the Christmas Period) will be despatched the same day using Royal Mail's First Class postal service.Orders received after 2pm will be despatched the following working day. Occasionally orders will be shipped using a service which may need to be signed for.
3.2 EU Orders : In stock orders received before 2pm Greenwich Mean Time, Monday to Friday, (excluding Bank Holidays and the Christmas Period) will be despatched the same day using Royal Mail's Surface Mail postal service (or airmail for orders over £20). Orders received after 2pm will be despatched the following working day. Occasionally higher value orders will be shipped using Airsure and may need to be signed for.
3.3 US & Canada Orders : In stock orders received before 2pm Greenwich Mean Time, Monday to Friday, (excluding Bank Holidays and the Christmas Period) will be despatched the same day using Royal Mail's Surface Mail postal service (or airmail for single miniatures and card orders). Orders received after 2pm will be despatched the following working day. Occasionally higher value orders will be shipped using Airsure and may need to be signed for.
3.4 Out of stock items will be shipped as soon as they become available.
3.5 Non-delivery : Items can only be claimed for after 14 days have elapsed. UK orders are covered up to their full value but non-UK orders are only covered for £34 unless International Plus was purchased at checkout.

Refunds
4.1 In the unlikely event that goods arrive damaged on delivery you must inform us without delay by contacting support@the13thfloor.co.uk so that we can arrange with you the return of the item(s) and either issue a replacement or refund as appropriate.
4.2 If you are a consumer, you have the right to cancel the contract for the purchase of any part of the order within 7 working days of delivery and your payment will be returned. To cancel the contract, you must first inform us within 7 working days of the day you receive the goods from us. You can inform us by email (support@the13thfloor.co.uk) or post at D'Avekki Studios, Fleetwood, West End, Gorefield, PE13 4PH, UK. Following cancellation, goods must be returned to us in original unused condition including packaging (with any seals and shrink wrapping intact).
We do not accept liability for the costs of return, returns damaged in transit or not received by us. For your protection, we recommend that you make sure the goods are adequately packaged and insured for their return journey.

Liability

6.2 You have the right to cancel the order if we are unable to deliver within 30 days. We will not be liable for any compensation or damages as a result of late or non-delivery.
6.3 We do not accept any responsibility for any web site not under our control which may be linked to this site.
6.4 In respect of compensation or damages we limit our liability to the total sale amount received for your order.

Customer Information
7.1 We may hold information about you on our databases for the purposes of running our business. This information will be used for administering your order and we may use the information to contact you from time to time if you have requested such information. You accept that we may send you information regarding your order and order status via email.
7.2 By placing your order you are agreeing to allow us to use your personal details for the purpose of supplying goods which may include passing details on to third parties eg suppliers, couriers and subcontractors.

General
8.1 The 13th Floor is a trading name of D'Avekki Studios Limited(registered in the UK: company number 4989192).
8.2 These Terms and Conditions shall be governed by the laws of England, UK. Any dispute or controversy, not resolved in the normal way, shall be subject to the exclusive jurisdiction of the laws of England, UK.
8.3 Each Term and Condition set out in this document shall be construed separately and will remain in force even if for any reason one or other of the Terms or Conditions is held inapplicable or unenforceable.
8.4 Section headings have been included in these Terms and Conditions for convenience only and are not to be used in their interpretation.
8.5 These terms and conditions are subject to change at any time without prior notice to you.
8.6 Your statutory rights are not affected by these terms and conditions.

XPs (aka Pointacles) Service
9.1 XPs are provided as a free service.
9.2 You must make sure your Rewards are applied before making payment. If you do not think you are receiving the correct rewards please contact the store.
9.3 Rewards relating to free items including sleeves and dice are subject to availability. In order not to delay your order it will still be processed if free items are unavailable. You will be credited 5XPs for each unavailable item.
9.4 We reserve the right to cancel the XPs service. You will receive one months notice to enable you to use your remaining XPs if you wish.
9.5 XPs, Rewards and user accounts are non-transferable.
9.6 The XPs service is provided to private individuals only, and should not be used by trade customers, clubs or buying groups.
